Terms of service

1. Who we are

EpokSports is operated by EpokSports, Inc. It is a platform for organising games and competitions inside communities, and for keeping the results, ratings and standings that come out of them.

By creating an account or using the platform you accept these terms. If you do not accept them, do not use the platform.

2. Eligibility and your account

You must be at least 13 years old to hold an account, or older where the law that applies to you sets a higher minimum age. One account per person. You are responsible for keeping your login details safe and for everything done under your account.

Guest participants can be added to a session by an organiser without an account. Whoever adds them is responsible for having their agreement.

3. Communities and organisers

Communities are created and run by their members. An organiser sets up sessions, confirms scores, and can correct a result while a session is running or after it has been completed. Organisers are not employees or agents of EpokSports, Inc.

We may remove a community, a session or an account that breaks these terms.

4. Results, ratings and standings

Results are entered by the people playing. We present what was entered and the standings that follow from it. We do not verify results and we make no promise that a record is complete or accurate.

Ratings, standings and awards are features of the platform. They carry no monetary value and confer no entitlement.

5. Subscriptions and payments

EpokSports offers paid subscriptions: Player Pro and Facility Pro. They are billed monthly in advance and charged through our payment processor, Stripe, which handles your card details. We do not store your card number.

A subscription renews every month until you cancel. You can cancel at any time in Settings; the subscription then stops renewing and the paid features stay available until the end of the period you have already paid for. We do not refund the current month. Where the law that applies to you gives you a right to cancel a new subscription and be refunded, that right applies in addition to this. We may change prices, and we will tell you before a change affects what you pay.

Apart from subscriptions, no money moves through the platform. Court bookings are agreed and settled directly between the player and the venue. Where an organiser sets an entry fee for a competition, it is settled between the people involved. The platform records what was agreed and tracks what is outstanding. We hold no funds and we are not a party to those transactions.

6. Virtual items

Any virtual item, badge, award or in platform status has no cash value, cannot be exchanged for money or goods, and is not transferable between accounts.

Virtual items are licensed to you for use inside the platform, not sold. We may modify, withdraw or reset them, and they are revoked when an account is closed. Nothing in this section creates a debt or a refundable balance.

7. Acceptable use

Do not post false results, harass or threaten other people, impersonate anyone, scrape or attack the platform, or use it to solicit business without our agreement.

Do not upload content you do not have the right to upload.

8. Your content

You keep ownership of what you post. You grant us a licence to store, display and distribute it inside the platform so the platform can work.

You can delete your content and your account from Settings.

9. Our intellectual property

The platform itself is ours: the EpokSports name, the ES mark and the wordmark, the site and the app, their design, text, layout and code, and the structure of the competition formats we have built. All of it belongs to EpokSports, Inc. or is used by us under licence, and is protected by copyright, trade mark and other laws.

Using the platform gives you no rights in any of it beyond using the platform as these terms allow. Do not copy, adapt, republish or reverse engineer it, and do not use our name or marks — in a product, a listing, an advertisement, or in a way that suggests we endorse you — without our written agreement.

Clubs and organisers may say they run their games on EpokSports and may use our name plainly to do so. That permission ends if these terms end.

10. Indemnity

If something you do brings a claim against us, you cover it. You agree to indemnify EpokSports, Inc., and to hold us harmless against any claim, loss, liability, cost or reasonable legal fee that arises out of your use of the platform, anything you post or record on it, a session or competition you organise, your dealings with a venue, an organiser or another player, or your breach of these terms or of any law.

This does not apply to the extent the claim is caused by our own breach of these terms, and nothing in this section takes away a right you have that cannot lawfully be given up.

We may take over the defence of any claim covered by this section, and if we do you agree to help us with it. You may not settle a claim in a way that admits fault on our behalf or commits us to anything without our written agreement.

11. Other services we rely on

The platform runs on services provided by other companies — hosting, the database and sign in, payment processing, maps and fonts among them. Our privacy policy names the ones that handle personal data. Where you use one of those services through us, that company’s own terms apply to you as well as ours.

The platform also links out, including to our app, to venue websites and to map services. We do not control those destinations, we are not responsible for what is on them or for what they do with information you give them, and a link is not an endorsement.

If one of these services fails, is withdrawn, or changes what it does, the platform may be interrupted or a feature may change or stop. Section 12 covers availability.

12. Availability

The platform is provided as it is. We do not promise it will be uninterrupted or free of faults, and features may change.

We may suspend access for maintenance or to protect the platform and the people using it.

13. Liability

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence.

Otherwise we are not liable for indirect or consequential loss, or for disputes between players, organisers and venues, including anything to do with money settled outside the platform.

Sport carries risk. You take part at your own risk and are responsible for your own fitness and insurance.

14. Ending your use

You may stop using the platform and delete your account at any time. Closing your account also ends any subscription; we do not refund the current month. We may close an account that breaks these terms.

When an account is closed, virtual items and in platform status are revoked. Results already recorded in a community may remain visible to that community as part of its history.

15. Changes to these terms

We may update these terms. Where a change is significant we will show a notice inside the app. Continuing to use the platform after a change means you accept the updated terms.

16. Governing law

These terms are governed by the law of the country in which you use the platform, and you may bring proceedings in the courts of that country. Nothing here removes rights you have under the consumer law that applies to you.

Where local law requires specific terms, those terms apply to you in place of anything inconsistent above.
